Terms and Conditions

1. Scope of Application

These Terms and Conditions govern all contracts between Bitwater LLC, trading as Nerdminer Store (the Seller), and its customers (the Customer) regarding the sale of mining hardware and accessories. The version you agree to at checkout is the version that applies to your order.

2. Products and Orders

The Seller offers Bitcoin mining hardware, including but not limited to Bitaxe, NerdAxe, NerdQAxe and NerdMiner devices, which are primarily intended for solo and home mining.

  • Your order is an offer. The contract comes into existence when we confirm the order by email.
  • Some products are pre-orders and ship at a later date. The expected shipping date is shown on the product page.

3. Prices and Payment

All prices are in Euro and include VAT. Shipping costs are shown before you order and on our shipping page.

  • Payment methods. Bitcoin and Lightning through our BTCPay Server, card, Apple Pay, Google Pay, PayPal and bank transfer. We do not add a surcharge for any payment method.
  • Taxes and duties. Inside the EU, VAT is included in the price and there are no further charges. Outside the EU, your customs authority may charge import duty and local VAT, which you pay.

4. Shipping and Delivery

  • We ship from Europe with UPS or DHL, fully tracked.
  • Delivery times shown on the site are estimates for the carrier, counted from dispatch.
  • Risk passes to you when the parcel is handed to you. If a parcel is lost or damaged in transit, tell us and we sort it out with the carrier.
  • If we cannot deliver within 30 days, you can set a short additional period and then cancel the order and get your money back.

5. Right of Withdrawal and Refunds

You may withdraw from your purchase within 14 days of receiving the goods, without giving a reason. How it works, what we refund and when, is set out in full on our withdrawal page and in our returns policy. Nothing in these terms limits those rights.

6. Liability

  • Every device is tested before it leaves us.
  • Mining is not an investment product. We do not promise any yield, and we are not liable for changes in network difficulty, Bitcoin price or electricity cost.

7. Applicable Law and Disputes

  • The seller is Bitwater LLC, 5830 E 2nd St, Ste 7000, Casper, WY 82609, United States of America.
  • As a consumer you can always bring a claim before the courts of the country you live in, and the consumer protection rules of that country apply to you. Nothing here changes that.
  • We are not obliged to take part in dispute resolution before a consumer arbitration board, and we do not take part voluntarily.

How we handle personal data is described in our privacy policy.

9. Final Provisions

  • We may change these terms for future orders. The version you agreed to at checkout is the one that applies to your order, and a copy is attached to your order confirmation.
  • If any provision of these terms is invalid, the rest stays in effect.
